Welcome to Kitably.

These Terms & Conditions (“Terms”) govern your access to and use of the Kitably website, mobile application, content, services and related features (collectively, the “Platform”).

By accessing or using Kitably, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Platform.

1. About Kitably

Kitably is a digital knowledge and eBook discovery platform that provides users with access to information about eBooks, digital products, educational content and related resources.

Kitably may display, promote or provide information about eBooks and digital products that may be available for purchase through third-party platforms.

Kitably does not necessarily process or complete the purchase transaction directly.

Where an eBook or digital product is purchased through a third-party platform such as Cosmofeed, the applicable third-party platform may be responsible for payment processing, order processing, digital delivery, transaction records, refunds (where applicable), affiliate tracking and commission-related activities.

2. Acceptance of Terms

By using Kitably, you confirm that:

  • You have read and understood these Terms.

  • You agree to comply with these Terms.

  • You will use the Platform only for lawful purposes.

  • The information you provide to Kitably, where applicable, is accurate and not misleading.

  • You will not use the Platform in a way that violates applicable laws or the rights of others.

If you do not agree to these Terms, you should discontinue use of the Platform.

3. Use of the Website and App

You may use Kitably for personal, educational and lawful purposes.

You must not:

  • Use the Platform for unlawful activities.

  • Attempt to gain unauthorized access to the Platform or its systems.

  • Copy, reproduce or redistribute Kitably's content without permission.

  • Attempt to interfere with the operation or security of the Platform.

  • Upload, transmit or distribute malicious software or harmful code.

  • Misuse any promotional, referral or affiliate links.

  • Use Kitably to engage in fraud, deception or misleading activities.

  • Scrape, reproduce or commercially exploit Platform content without authorization.

Kitably reserves the right to restrict or terminate access where misuse is reasonably suspected.

4. eBooks and Digital Products

Kitably may display information about various eBooks and digital products.

Product titles, descriptions, covers, prices, availability and other information may be changed from time to time.

Where a purchase button or external link directs you to a third-party platform:

  • The transaction may take place entirely on that third-party platform.

  • You may be required to accept the third party's terms and policies.

  • Payment may be processed by the third-party platform or its payment partners.

  • Delivery/access to the purchased digital product may be provided by the third-party platform.

  • The third party's refund, cancellation and transaction policies may apply.

Users should review the applicable third-party terms before completing a purchase.

5. Payments

Kitably may not directly collect or process payments for products displayed on the Platform.

When you purchase an eBook through a third-party platform such as Cosmofeed, payment processing may be handled by that platform and/or its payment service providers.

Therefore, Kitably generally does not receive or store your complete payment card, bank account or other sensitive payment credentials.

For payment-related issues, users may need to contact the relevant third-party platform through which the transaction was completed.

6. Affiliate Program

Kitably may promote or provide information about affiliate opportunities associated with eBooks or digital products.

The affiliate program may be operated and administered by a third-party platform such as Cosmofeed and is not necessarily operated directly by Kitably.

Where applicable:

  • Affiliate registration may take place through the third-party platform.

  • Affiliate links may be generated and tracked by the third-party platform.

  • Sales attribution may be determined by the third-party platform.

  • Commission calculations may be handled by the third-party platform.

  • Affiliate payouts may be handled by the third-party platform.

  • Eligibility, commission rates, payment schedules and other affiliate conditions may be subject to the third-party platform's policies.

Kitably does not guarantee any particular amount of income, sales, commissions or earnings from affiliate activity.

Any earnings examples or promotional statements should not be interpreted as a guarantee of future income.

7. Intellectual Property

Unless otherwise stated, the Kitably name, logo, branding, website design, application interface, graphics, original text, promotional materials and other original content made available by Kitably are owned by or licensed to Kitably.

You may not, without prior written permission:

  • Copy or reproduce Kitably's branding.

  • Modify or distribute Kitably's original content commercially.

  • Use the Kitably name or logo in a way that suggests unauthorized affiliation.

  • Republish substantial portions of Kitably content on another website, app or platform.

Third-party trademarks, logos, book titles and other intellectual property remain the property of their respective owners.

8. User-Generated Content

If Kitably allows users to submit reviews, comments, feedback or other content, you are responsible for the content you submit.

You agree not to submit content that:

  • Is illegal or fraudulent.

  • Infringes copyright, trademark or other intellectual property rights.

  • Contains malicious software.

  • Is defamatory or deliberately misleading.

  • Violates another person's privacy.

  • Contains inappropriate or harmful material.

Kitably may remove content that violates these Terms or applicable law.

9. Educational and Informational Disclaimer

The content available through Kitably is provided for general informational and educational purposes.

eBooks and other content may contain opinions, suggestions, strategies or information relating to areas such as:

  • AI

  • Business

  • Finance

  • Marketing

  • Self-improvement

  • Technology

  • Career

  • Entrepreneurship

  • Other educational subjects

Such information should not automatically be treated as professional, financial, legal, medical or investment advice.

You are responsible for evaluating information and obtaining professional advice where appropriate.

10. No Guarantee of Results

Kitably does not guarantee that using any eBook, educational material, strategy or information available through the Platform will produce a specific result.

For example, Kitably does not guarantee:

  • Business success

  • Financial profit

  • Employment

  • Increased income

  • Affiliate earnings

  • Sales

  • Personal or professional outcomes

Results depend on many factors, including individual circumstances, effort, market conditions and implementation.

11. Third-Party Links and Services

Kitably may contain links to websites, applications, payment services or other third-party platforms.

These third-party services are not necessarily controlled or operated by Kitably.

Kitably is not responsible for:

12. Availability of the Platform

Kitably aims to keep the website and application available and functional, but uninterrupted availability cannot be guaranteed.

  • Internet or network failures

  • Third-party service failures

  • Circumstances beyond Kitably's reasonable control

Kitably does not guarantee that all information displayed on the Platform will always be:

Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited under applicable law.

15. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold Kitably harmless from claims, losses, liabilities, damages and expenses arising from your:

  • Misuse of the Platform.

  • Violation of applicable law.

  • Infringement of another person's rights.

  • Unauthorized use of Kitably content or services.

16. Privacy

Your use of Kitably is also governed by our Privacy Policy, which explains how information may be collected, used and handled.

17. Refunds and Cancellations

Kitably may promote digital products that are purchased through third-party platforms.

Where a purchase is completed through a third-party platform, the refund, cancellation and purchase-related policies of that platform and/or the applicable seller may govern the transaction.

Users should review the applicable refund and cancellation terms before purchasing.

When changes are made, the updated version may be published on this page with a revised “Last Updated” date.

Your continued use of Kitably after updated Terms are published constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

19. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable in India.

Subject to applicable consumer-protection and other mandatory legal rights, disputes relating to the Platform shall be subject to the jurisdiction of the competent courts/authorities having jurisdiction over the applicable matter.
